WISE SNACK SQUAD INSTANT WIN GAME - BOSTON
Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO PLAY OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING.
1. ELIGIBILITY: Open only to legal residents of the states of MA, ME, NH, RI, VT and legal residents of only the following counties in the state of CT: Hartford, Litchfield, Middlesex, New Haven, New London, Tolland, Windham, who are aged 13 and older as of May 19, 2008 and are physically located within those states/counties (as appropriate) ("Territory") and who are not employees of Wise Foods, Inc. ("Sponsor"), New England Sports Ventures L.P. owner and operator of the Boston Red Sox ("Red Sox") and the other MLB Entities (defined below), National Railroad Passenger Corp. ("Amtrak"), Hewlett-Packard Development Company, L.P. , ("HP"), their parent companies, subsidiaries, affiliates, advertising, research and promotion agencies, and other business entities involved in administration of this promotion (hereinafter "Entities"). Immediate families of employees of Entities (spouses, children, siblings, in-laws and same household members whether or not related) are not eligible. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. "MLB.com"), SportsOnEarth, LLC, Tickets.com, Inc., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), Baseball Television, Inc. (d/b/a Major League Baseball International), the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities. Void in all jurisdictions outside Territory (including Florida, Puerto Rico, Guam, U.S. Virgin Islands and other United States possessions and territories) and where taxed, prohibited or restricted by law. Game is subject to all federal, state and local laws and regulations.
2. HOW TO PLAY: Game starts on or about May 19, 2008 and is scheduled to end on July 13, 2008 ("Game Period"). Regardless of scheduled end date, Game will officially end when all game cards have been distributed, subject to the prize claim deadlines (set forth in this Paragraph, below). During the Game Period, look for the Wise Snack Squad at events at or near stores selling Wise products throughout the Territory. A schedule of Wise Snack Squad event dates and locations is posted at www.wisesnacksquad.com/ortiz. EVENT SCHEDULE IS TENTATIVE, HOWEVER, AND IS SUBJECT TO REVISION BY SPONSOR AT ANY TIME PRIOR TO EVENT DATE WITHOUT LIABILITY OF ANY KIND. BE SURE TO PERIODICALLY CHECK THE WEB SITE FOR UPDATED INFORMATION REGARDING SCHEDULE. Wise Snack Squad members will distribute game cards to attendees at events, while supplies last. NO PRODUCT PURCHASE OR OTHER CONSIDERATION WILL BE REQUESTED OR REQUIRED IN ORDER TO OBTAIN A GAME CARD FROM THE WISE SNACK SQUAD.
If you cannot or do not wish to attend a Wise Snack Squad event, you may obtain a game card (while supplies last) via mail. Send a self-addressed stamped business size (#10) envelope to: WISE Snack Squad Boston Game Card Request, P.O. Box 745, Georgetown CT, 06829-0745, for receipt no later than July 7, 2008. Vermont residents only may omit return stamp. One request per outer mailing envelope. Submission of valid game card request will result in one entry in Second Chance random drawing (if necessary, see Paragraph 5 below).
To play Game, scratch off the indicated area on game card. If "You Win" message is revealed, you win the prize described thereon, subject to verification (if applicable). If "Sorry" message is revealed, you are not a winner.
Prize Claim: High-Level Prizes.
(A) Prize Claim. Internet access and valid e-mail address required. Log onto www.wisesnacksquad.com/ortiz and input the "Prize Code" (found on game card) in the "Did You Win Big?" field and after reading the "Congratulations" page click "Submit" to access on-line prize claim form. Next, input your full name, street address (no P.O. Boxes), daytime telephone number, evening telephone number, e-mail address, and date of birth on prize claim form. You must also check the box indicating that you have read and agree to the Official Rules. Then, click "Submit" and transmit your completed prize claim form. Be sure to input the "Prize Code" exactly as it appears on the game card; incomplete or incorrect "Prize Codes" will NOT be accepted (and you will not be able to access the prize claim form). Prize claim must be submitted by 11:59:59 p.m. ET on July 18, 2008. (Sponsor's computer is the official clock for the Game).
(B) Notification. After submission of prize claim form, winners will be notified by phone, e-mail, and overnight courier. Keep original game card as you may be required to submit same for verification purposes upon Sponsor's request. Failure to timely submit game card or timely and fully comply with any other request of Sponsor/Judges will result in disqualification and prize forfeiture (with an alternate winner being selected via the Second Chance random drawing [see Paragraph 5, below]). Winners will be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release (where legal) or a Declaration of Eligibility and Liability/Publicity Release (where legal), depending on prize potentially won, within three (3) days of notification. Winners of "Red Sox VIP For A Day" prize, taking batting practice on-field prize, and Red Sox tickets/watching batting practice on-field prize will also be required to sign additional releases relative to field access. Guests of winner may also be required to sign and return a Liability/Publicity Release, where legal, within 3 days of notification (and guests of "Red Sox VIP For A Day" and taking/watching batting practice prize winners will also be required to sign additional releases). If guest of the winner is a minor, Liability/Publicity Release (and additional releases, if applicable) must be signed by his/her parent or legal guardian. Failure to timely return signed Affidavit of Eligibility and Liability/Publicity Release (or Declaration of Eligibility and Liability/Publicity Release, where legal) will result in prize forfeiture and an alternate winner being selected via the Second Chance random drawing (see Paragraph 5 below).
Prize Claim: Low-Level Prizes.
If game card was obtained from Wise Snack Squad, prize is available immediately by returning the winning game card to a Wise Snack Squad member at event. If game card was requested via mail or if game card is not redeemed at event when received, print full name, street address (no P.O. Boxes), daytime telephone number and date of birth on a 3"x5" card and mail with original game card in a business size (#10) envelope to: WISE Snack Squad Boston Prize Claim, P.O. Box 774, Georgetown CT, 06829-0774, to be received by July 18, 2008. Keep a copy of the game card for your records. After verification, prize will be mailed to address provided on 3"x5" card. Proof of mailing/shipping does not constitute evidence that a winning game card was submitted.
In the event of noncompliance with these Official Rules, the prize will be forfeited. And, only forfeited High-Level Prizes will be awarded to alternate winners selected via the second chance drawing. If Low-Level Prizes are forfeited, they will NOT be awarded.
Upon forfeiture, no compensation will be given. If prize winner is a minor, any required documents must be signed by the minor's parent or legal guardian on his/her behalf; and, if winner is a minor, Sponsor in its sole discretion may award the prize in the name of or to winner's parent or legal guardian. If applicable, parent/guardian must travel with minor/accompany minor to game (i.e., parent/legal guardian must be either the prize winner or a guest).
3. RESTRICTIONS ON GAME CARDS/GAME PLAY.
The purchase, sale, transfer, auction of game card or "Prize Code" or the usage of a game card/"Prize Code" in any manner other than as specifically set forth in these Official Rules constitutes fraud and is prohibited. Any attempted form of participation other than as set forth herein is prohibited; automatic, programmed, robotic or similar means of participation are not permitted. Submission of game materials (including prize claims) is the sole responsibility of the participant. Any game materials (including prize claims) submitted become the sole property of Sponsor and will not be returned. Sponsor, Judges, the MLB Entities and each of their respective advertising/marketing, promotion and research agencies are not responsible for lost, late, damaged, incomplete, illegible, misdirected, stolen or postage due prize claims/mail; illegible, incomplete, defective or otherwise irregular game cards/"Prize Codes," or for technical errors of any kind including computer/information network failures, hardware, software, telephone or other communications malfunctions of any nature, errors or failures of any kind, lost or unavailable telephone or network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit a participant's ability to take part in the Game.
If, for any reason, Sponsor determines that the online submission of prize claims for High-Level Prizes is not capable of running as originally planned (e.g., computer virus, unauthorized intervention, fraud, technical failures), Sponsor reserves the right in its sole discretion to suspend, modify or terminate the online prize claim procedure. In such event, Sponsor/Judges will require all prize claims to be submitted by mail by following the procedure for mail-in redemption of Low-Level Prize Claims, as set forth above; however, Sponsor reserves the right to take actions in addition to or instead of the foregoing so to make all High-Level prizes available and conduct the Game in a manner which is fair, appropriate and consistent with these Official Rules (as determined by Sponsor in its sole discretion). Notice of such action by Sponsor will be posted on web site. CAUTION: Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the Game is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor and the MLB Entities reserve the right to seek damages from any such participant to the fullest extent permitted by law and disqualify such participant from the Game.
Game cards are void and will be rejected if not obtained through authorized, legitimate channels or if any part is determined by the Wise Snack Squad and/or the Judges, in the sole discretion of either party (as appropriate), to be illegible, mutilated, counterfeited or tampered with in any way or if materials contain printing, typographical, mechanical or other errors. If because of seeding or other error or for any other reason, there are more claims in any prize category than prizes offered in such category, a random drawing will be held from among all eligible claimants in such category to award only the prizes for such category (previously not awarded) as set forth in these Official Rules. Only the number of prizes stated in these Official Rules are available to be won in the Game. Liability of Sponsor for an irregular or defective game card is limited to replacement with another randomly selected game card, provided supplies last. Any attempt to forge game cards or defraud Sponsor in any way will result in disqualification of participant; and, such participant is subject to prosecution to the full extent of the law.
IF LOW-LEVEL PRIZES ARE FORFEITED OR UNCLAIMED, THEY WILL NOT BE AWARDED. IF ANY HIGH-LEVEL PRIZES ARE FORFEITED OR UNCLAIMED, SUCH HIGH-LEVEL PRIZES WILL BE AWARDED VIA THE SECOND CHANCE DRAWING (SEE PARAGRAPH 5).

* Watching batting practice on-field, watching the Red Sox game from inside the Green Monster and taking batting practice on-field have no retail value and are subject to availability and timing, weather and other exigencies on date of game. If, for any reason, watching batting practice on-field and/or watching the game from inside the Green Monster cannot be awarded, the other elements of the applicable prize shall constitute Sponsor's entire liability to winner; if, for any reason, taking batting practice prize(s) cannot be awarded, Sponsor shall have no liability to winner(s). Watching batting practice and taking batting practice prize winners, winner of "Red Sox VIP For A Day" prize and their respective guests will be permitted field access for the sole purpose of (as applicable) taking/ watching batting practice and/or watching game from inside the Green Monster, and those prize elements shall be subject to restrictions/policies established by the Red Sox in their sole discretion and winner agrees to comply fully with all such restrictions/policies.

Limitations on Prizes:
Limit One (1) High-Level Prize per person/family/household. All expenses not specified in these Official Rules, including, without limitation, all state, Federal or local taxes, insurance, meals (except where otherwise noted), gratuities, spending money and phone calls, are winners' sole responsibility. Any unforeseen expenses or costs incurred in connection with a prize that are beyond control of Sponsor or the MLB Entities including, but not limited to, losses incurred in shipping or additional travel, hotel, airline and transportation charges resulting from travel delays, modification and cancellations, are the sole responsibility of winner. Prizes awarded are nontransferable and non-endorsable. The prizes (or any portion thereof) cannot be sold or transferred. No prize substitutions allowed, except at Sponsor's sole discretion in the event of prize unavailability for any reason, and then only for a prize of equal or greater value (except where otherwise noted). All baseball game tickets are also subject to terms and conditions of use, as indicated thereon. Winners of tickets to Red Sox home games are solely responsible for transportation to and from Fenway Park, Boston, MA. Winners of tickets to baseball games agree and understand that, subject only to the restrictions on the ticket itself, such tickets are good only for the indicated game. High-Level trip prize winner must travel on date and time of Sponsor's sole choosing so as to attend indicated game in Bronx, New York; if winner is unavailable on such dates/times, prize will be forfeited and an alternate winner selected. Trip prize winner and guest must travel on same itinerary as set by Sponsor in its sole discretion. MLB game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Red Sox and/or the New York Yankees, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. The MLB Entities and Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of MLB games.
5. SECOND CHANCE DRAWING: If any High-Level Prizes are unclaimed, such prizes will be awarded via a random drawing from all valid mail-in game card requests received. The random drawing (if necessary) shall be conducted by PHD Marketing Services LLC, an independent judging agency (the "Judges") whose decisions are final and binding in all respects. The drawing will be conducted on or about July 25, 2008. Odds of winning prize in Second Chance Drawing depend on the total number of eligible entries received and number of unclaimed High-Level Prizes. Winners, if any, will be notified by phone, e-mail, and overnight courier.
6. CONDITIONS: All taxes are the sole responsibility of the winner accepting the prize. A 1099MISC Federal tax form will be issued to the winner for the fair market value of High-Level Prizes with a value of $600 or more. By participating, entrant (if entrant is a minor, his/her parent or legal guardian) agrees to abide by and be bound by these Official Rules and the decisions of the Wise Snack Squad and/or Judges (as applicable), which are final and binding in all respects. Participation in game and acceptance of prize constitutes winner's permission (if winner is a minor, his/her parent or legal guardian's permission) for the Sponsor and the MLB Entities to use winner's name, address (city and state only), likeness and any statements made by winner for advertising, trade and promotional purposes without additional compensation, except where prohibited by law. By participating in Game or acceptance and use of prize, winner (if winner is a minor, his/her parent or legal guardian) agrees to release, hold harmless and indemnify Sponsor, New England Sports Ventures L.P. and Entities and their respective parent organizations, affiliates, governors, partners, agents, subsidiaries, advertising/promotional service agencies, independent contractors, and the officers, directors, employees, agents, successors and assigns of all of the foregoing entities (collectively, the "Releasees") against any and all liability, damages or causes of action (however named or described), with respect to or arising out of participation in the Game, or the receipt, acceptance, possession or use/misuse of the prizes awarded herein. The Releasees have no liability or responsibility for any personal injuries, losses or damages or claims of any kind resulting from participation in the Game, acceptance, possession or use/misuse of any prize. Entrants who do not comply with the Official Rules or attempt to interfere with this Game in any way shall be disqualified. Interference includes but is not limited to failing to follow the instructions of the Wise Snack Squad and/or acting in a manner that member(s) of the Wise Snack Squad in their sole discretion determine to be inappropriate, obnoxious or anti-social; and, in the event of such conduct, Sponsor reserves the right to take any other actions it deems appropriate, beyond disqualification of participant, so as to protect its rights.
7. ADDITIONAL TERMS: For details regarding collection of information from users of the Web site (including Game participants), please consult Sponsor's privacy policy on the Web site, accessible at: http://www.wisesnacks.com/privacy.html. Additionally, Sponsor and the MLB Entities reserve the right to prosecute any fraudulent activities to the full extent of the law.
8. WINNERS LIST. For the names of prize winners (of prizes with a value of over $15), send a self-addressed stamped envelope, no later than September 26, 2008 to: WISE Snack Squad Boston Instant Win Game Winners List, P.O. Box 746, Georgetown, CT 06829-746.

It is NOT necessary to have a potentially winning Prize Code from the Wise Snack Squad Instant Win Game in order to enter the Sweepstakes. Next, input your full name, street address (no P.O. Boxes), daytime telephone number, evening telephone number, e-mail address, and date of birth on the official entry form. If you like, you may play the "Swing for the Fences" game. However, playing "Swing for the Fences" is for entertainment purposes only. Whether or not you choose to play "Swing for the Fences" and, if you do play, your score in the game will NOT affect your ability to enter the Sweepstakes or your odds of winning a prize in the Sweepstakes. You must also check the box indicating that you have read and agree to the Official Rules. Then, click "Submit" and transmit your completed entry form. 3. RESTRICTIONS/LIMITATIONS ON ENTRY.
Entries generated by script, macro, robotic, programmed or like means are prohibited and will be disqualified. Sponsor, Judges, the MLB Entities and each of their respective advertising/marketing, promotion and research agencies are not responsible for lost, late, damaged, incomplete, illegible, misdirected or stolen entries; or for technical errors of any kind including computer/information network failures, hardware, software, telephone or other communications malfunctions of any nature, errors or failures of any kind, lost or unavailable telephone or network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit a person's ability to enter the Sweepstakes. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the Authorized Account Holder of the e-mail account from which the entry is submitted as of date of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
4. RANDOM DRAWING/WINNER NOTIFICATION. Prize winners will be selected via random drawing from all valid entries received. The random drawing shall be conducted by PHD Marketing Services LLC, an independent judging agency (the "Judges"), whose decisions are final and binding in all respects. The drawing will be conducted on or about July 16, 2008.
Winners will be notified by phone, mail, e-mail and/or overnight courier (method of notification is of Sponsor's sole choosing). If winner cannot be contacted or prize/prize notification is returned as undeliverable for any reason, prize will be forfeited* and an alternate winner selected from among all remaining valid entries received. Winners (if winner is a minor, his/her parent or legal guardian) will be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release (where legal) or a Declaration of Eligibility and Liability/Publicity Release (where legal), depending on prize potentially won, within three (3) days of notification. If winner is a minor, Sponsor in its sole discretion may award the prize in the name of or to winner's parent or legal guardian. For Red Sox Ticket Prize/Batting Practice Prize, parent/legal guardian must travel with minor/accompany minor to game (i.e., parent/legal guardian must be either the prize winner or the guest of winner). Winner of Batting Practice Prize will also be required to sign additional releases relative to field access. Guest of Red Sox Ticket Prize winner/Batting Practice Prize winner may also be required to sign and return a Liability/Publicity Release, where legal, within 3 days of notification (and guest of Batting Practice Prize winner will also be required to sign additional releases). If guest is a minor, Liability/Publicity Release (and additional releases, if applicable) must be signed by his/her parent or legal guardian. Failure to timely return signed Affidavit of Eligibility and Liability/Publicity Release (or Declaration of Eligibility and Liability/Publicity Release, where legal) will result in prize forfeiture* with an alternate winner being selected.
*{If prize is forfeited, no compensation will be given.}
5. PRIZES/ESTIMATED PRIZE VALUES
Batting Practice Prize (1) - winner and one (1) guest will take batting practice on the playing field at Fenway Park before a 2008 Red Sox regular season home game subject to the rules and regulations of the Boston Red Sox; and will receive (2) tickets to that Red Sox game. Estimated Prize Value: $1,000.
Batting Practice Prize is subject to availability and timing, weather and other exigencies on date of game. If, for any reason, batting practice component of prize cannot be awarded, the other elements of the prize shall constitute Sponsor's sole liability to winner. Prize winner and his/her guest will be permitted field access for the sole purpose of taking batting practice, subject to restrictions/policies established by the Boston Red Sox in their sole discretion and winner agrees to comply fully with all such restrictions/policies.
Red Sox Ticket Prize (1) - Pair of Tickets to a 2008 Red Sox regular season home game (game and seat locations selected at Sponsor's and Red Sox' sole discretion). Estimated Prize Value: $100.
Baseball game tickets are also subject to terms and conditions of use, as indicated thereon. Prize winners are solely responsible for transportation to and from Fenway Park, Boston, MA. Winners agree and understand that, subject only to the restrictions on the ticket itself, such tickets are good only for the indicated game. MLB game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Red Sox, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. The MLB Entities and Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of MLB games.
David Ortiz Prize (2) - David Ortiz, #34, Boston Red Sox jersey. Estimated Prize Value: $75 each.
Entertainment Prize (2) - Interactive portable entertainment device. Estimated Prize Value: $75 each.
Total Estimated Value of all Prizes: $1,400
Odds of winning depend on the total number of valid entries received.
6. CONDITIONS OF PARTICIPATION.
Limit one prize per person/family/household. All expenses not specified in these Official Rules, including, without limitation, all state, Federal or local taxes, insurance, meals, gratuities and spending money are winners' sole responsibility. Any unforeseen expenses or costs incurred in connection with a prize that are beyond control of Sponsor or the MLB Entities including, but not limited to, losses incurred in shipping, are the sole responsibility of winner. Prizes awarded are nontransferable and non-endorsable. Prizes (or any portion thereof) cannot be sold or transferred. No prize substitutions allowed, except at Sponsor's sole discretion in the event of prize unavailability for any reason, and then only for a prize of equal or greater value.
All taxes are the sole responsibility of the winner accepting the prize. By participating, entrant (if entrant is a minor, his/her parent or legal guardian) agrees to abide by and be bound by these Official Rules and the decisions of the Judges. Entering Sweepstakes and acceptance of prize constitutes winner's permission (if winner is a minor, his/her parent or legal guardian's permission) for the Sponsor and the MLB Entities to use winner's name, address (city and state only), likeness and any statements made by winner for advertising, trade and promotional purposes without additional compensation, except where prohibited by law. By entering Sweepstakes and acceptance and use of prize, winner (if winner is a minor, his/her parent or legal guardian) agrees to release, hold harmless and indemnify Sponsor, New England Sports Ventures L.P. and Entities and their respective parent organizations, affiliates, governors, partners, agents, subsidiaries, advertising/promotional service agencies, independent contractors, and the officers, directors, employees, agents, successors and assigns of all of the foregoing entities (collectively, the "Releasees") against any and all liability, damages or causes of action (however named or described), with respect to or arising out of participation in the Sweepstakes, or the receipt, acceptance, possession or use/misuse of the prizes awarded herein. The Releasees have no liability or responsibility for any personal injuries, losses or damages or claims of any kind resulting from participation in the Sweepstakes, acceptance, possession or use/misuse of any prize. Entrants who do not comply with the Official Rules shall be disqualified.
If, for any reason, Sponsor determines that the Sweepstakes is not capable of running as originally planned (e.g., computer virus, unauthorized intervention, fraud, technical failures), Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. In such event, Sponsor/Judges will conduct the random drawing from among all valid entries received prior to and/or after (as appropriate) the action taken by the Sponsor or award the prizes by some other means determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted on web site. CAUTION: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of the criminal and civil laws. Should such an attempt be made, the Sponsor and the MLB Entities reserve the right to seek damages from any such entrant to the fullest extent permitted by law and disqualify such entrant from the Sweepstakes.

Additionally, Sponsor and the MLB Entities reserve the right to prosecute any fraudulent activities to the full extent of the law.
